Properly Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the services provided by Properly (“the Company”, “we”, “our”, “us”). By placing an order or using our services, you agree to be bound by these Terms.

1. Service Description

Properly provides marketing videos generated using artificial intelligence technology. Users provide information, images and branding materials, and the Company delivers a completed video file.

2. AI Generated Content

All videos are created using artificial intelligence. Due to the nature of this technology, outcomes may differ with each use, even when identical inputs are submitted. The Company does not guarantee identical or specific creative results.

3. Finality of Deliverables

All videos are provided as final deliverables. The Company does not offer revisions, edits, re-runs or modifications of videos once delivered.

4. Refund Policy

All sales are final. The Company does not provide refunds, credits or chargebacks once an order has been placed.

5. User Responsibilities

Users are solely responsible for ensuring that they have the legal right to submit all content, including but not limited to images, text, logos and branding materials. The Company accepts no liability for copyright, trademark or intellectual property infringements resulting from user submissions.

6. Music and Licensing

The Company provides royalty free background music for use in videos. Users are permitted to use delivered videos for marketing and promotional purposes without additional licensing fees.

7. Video Formats and Variations

Videos may be created in different formats, for example landscape or mobile. When a video is adapted from one format to another, such as from landscape to mobile, minor differences may occur. These differences may result from the way images are cropped or resized. Such variations are a natural outcome of the process and do not constitute a fault or error.

Where a customer requests both a desktop version and a mobile first version of the same property video, two separate videos must be generated. This requires two credits, as each video is treated as a unique deliverable.

8. Watermarking

Users may choose to accept a discounted rate in exchange for including the Company watermark on videos. Where this option is chosen, users must not alter, obscure or remove the watermark.

9. Delivery

The Company aims to deliver videos on the same business day following receipt of complete materials from the user. The Company is not liable for delays caused by incomplete submissions, user error or technical issues beyond its control.

10. Limitation of Liability

The Company provides all videos “as is” without any warranty, express or implied. The Company shall not be held liable for any direct, indirect, incidental or consequential losses or damages arising from the use of its services. The maximum liability of the Company for any claim shall not exceed the amount paid by the user for the specific order in question.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
